Supplemental Terms for Mindbody Franchise Fees Tool

These Franchise Fees Tool terms (“Franchise Fees Tool Terms”), together with the overhead agreement which refers to this supplement as being applicable between the Parties (the “Mindbody Terms of Service”), govern your use of the Franchise Fees Tool. Capitalized terms used in these Franchise Fees Tool Terms but not otherwise defined herein will have the meaning given to them in the Mindbody Terms of Service.

As a condition of utilizing the Franchise Fees Tool, you represent and warrant that you: (1) have the necessary authorization from the respective Franchisee and/or Affiliate to collect funds from their account; (2) are solely responsible for acquiring the required payment information for each Franchisee and/or Affiliate and accurately inputting that information into the Franchise Fees Tool; (3) will conduct timely review of all franchise fees reports to approve the transfer of funds; and (4) will utilize Payment Services in order to collect funds. You acknowledge and agree that upon approval of a franchise fee report, the transfer of funds cannot be reversed or corrected. You are solely responsible to resolve any disputes that may arise with Franchisees and/or Affiliates regarding funds, including, but not limited to, insufficient funds being available.
